The SSA disburses $1.4 trillion in benefits annually to over 71 million individuals, with a commendable accuracy rate in most cases. However, approximately 0.5% of beneficiaries may experience overpayments in Social Security benefits, a figure that rises to 8% for the Supplemental Security Income (SSI) program. The agency is legally obligated to adjust benefits or recover debts in such instances.

Case-by-Case Overpayment Determination

Acting Commissioner of Social Security, Kilolo Kijakazi, notes that the amount to be repaid is calculated on a case-by-case basis and is subject to appeal if the recipient disputes the overpayment. The agency is committed to enhancing the appeals and waivers process for individuals who may have been overpaid.

Recent Changes and Ongoing Initiatives

The SSA has already implemented certain changes, including the introduction of a simplified waiver request form. This form is designed to be more comprehensible, easing the burden on individuals seeking debt recovery waivers.

Moreover, the SSA is in the process of developing an electronic payroll data exchange program to automatically adjust payment amounts based on wage information, minimizing the occurrence of overpayments.

Acknowledging the agency’s high accuracy rates, Kijakazi has initiated a comprehensive review of overpayment policies and procedures. A dedicated team, led by a senior official reporting directly to the Commissioner, is tasked with identifying areas for improvement in serving customers.

Clarification on Recovery Figures

Contrary to recent media claims, Kijakazi clarifies that the SSA is not attempting to reclaim $21 billion in payments. This figure represents the total historical overpayments, with the agency seeking to recover $4.7 billion in 2022.

Causes of Overpayments and Notification Process

Overpayments can occur for various reasons, such as failure to report changes in income, living situation, marital status, or work ability. Recipients are notified of overpayments and provided with details on the reason, amount, repayment options, and appeal and waiver rights.

Consequences of Overpayments and Resolution Options

If recipients agree with the overpayment and its amount, they are advised to review repayment options. Failure to repay may result in withholding of the full benefit amount or a 10% withholding of the maximum federal benefit rate for SSI recipients. Individuals affected by overpayments can petition for reduced repayment or request a waiver. Non-repayment may adversely impact credit scores and lead to deductions from future tax refunds and benefit payments.

Appeals and Financial Hardship Considerations

Recipients who believe there was an error can file an appeal using form SSA-561 to contest the overpayment or its amount. The SSA offers additional options for those facing financial hardship, making it unlikely they can repay the overpaid amount.
